Important alarm notice
WakeMeUp is intended as a personal alarm and wake-up aid. Mobile devices, operating systems, permissions, battery restrictions, app termination, hardware, media services, and network conditions can prevent or interrupt any third-party alarm app. Do not use WakeMeUp as the only alarm where a missed alert could cause injury, missed medication, loss, caregiving failure, travel disruption, or another serious consequence.
1. Agreement to these terms
These Terms of Service ("Terms") are an agreement between you and TecDesigns LLC, doing business as WakeMeUp ("WakeMeUp," "we," "us," or "our"), concerning the WakeMeUp mobile application, wakemeup.website, support services, and related services (collectively, the "Services").
By downloading, accessing, purchasing through, or using the Services, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Services.
If you are under the age of legal majority where you live, you may use the Services only with permission and supervision from a parent or legal guardian.
2. What WakeMeUp provides
WakeMeUp provides alarm scheduling, question challenges, optional local and Spotify media selection, diagnostic tools, and optional question bundles. Features may vary by platform, operating-system version, device, permissions, region, app-store status, and third-party availability.
We may add, modify, suspend, or discontinue features. We do not promise that every feature will remain available or work identically on every device.
3. Alarm reliability and your responsibilities
You are responsible for configuring and testing the app before relying on it. This includes:
- Allowing required notifications, alarms, full-screen presentation, audio, and other device permissions.
- Keeping the device powered, charged, audible, functional, and appropriately connected.
- Avoiding force-stop, restricted battery modes, or platform settings that block alarms.
- Testing the alarm after app updates, operating-system updates, device changes, permission changes, or restored backups.
- Using a separate backup alarm for important or safety-sensitive events.
Spotify, imported local media, and other custom sounds are convenience features. WakeMeUp may substitute a bundled fallback if selected media is unavailable, but fallback playback is not guaranteed in every device state.
4. In-app purchases
Optional question bundles may be sold as non-consumable in-app purchases through Apple or Google. Prices, currencies, taxes, availability, family-sharing behavior, and payment processing are controlled by the applicable app store.
Purchases are tied to the Apple ID or Google account used at checkout. WakeMeUp may verify purchases with the applicable store before granting or restoring content. You agree not to falsify, alter, reuse improperly, or interfere with purchase-verification information.
Refunds and payment disputes are governed by the app store's policies and must generally be requested from Apple or Google. Removing the app or deleting local data does not automatically create a refund.
5. Third-party services
The Services may interact with Apple, Google, Spotify, reCAPTCHA, hosting providers, email providers, and other third parties. Those services are independent and subject to their own agreements and privacy practices.
Spotify functionality requires the Spotify app, user authorization, and network access, and may require a paid Spotify plan. WakeMeUp is not affiliated with, sponsored by, or endorsed by Spotify. Apple and Google are not responsible for providing WakeMeUp support except as required by their own terms or applicable law.
6. Acceptable use
You agree not to:
- Use the Services for unlawful, fraudulent, abusive, or harmful purposes.
- Attempt to bypass purchase verification, unlock paid content without authorization, or manipulate store transactions.
- Interfere with the Services, servers, security controls, rate limits, or another person's use.
- Introduce malware, automated abuse, scraping, denial-of-service traffic, or unauthorized requests.
- Reverse engineer or modify the Services except where applicable law expressly permits it.
- Use imported audio or Spotify content in a way that infringes copyright, license restrictions, or third-party terms.
We may restrict server access, support, purchases, or other functionality where we reasonably believe these Terms, store rules, security, or law have been violated.
7. Intellectual property and license
WakeMeUp, its software, website design, branding, original text, question content, graphics, and related materials are owned by or licensed to TecDesigns LLC and are protected by applicable intellectual-property laws.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control under the applicable app-store usage rules.
You retain ownership of audio files you select. You are responsible for having the right to use those files. Spotify content remains subject to Spotify and applicable rights-holder terms.
8. Feedback and support submissions
You may send bug reports, suggestions, or other feedback. You grant us permission to use feedback without restriction or compensation, provided we handle personal information as described in the Privacy Policy. Do not submit confidential information, passwords, full payment credentials, or content you do not have the right to share.
9. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that alarms, notifications, audio, Spotify playback, purchases, questions, website functions, or server services will be uninterrupted, exact, error-free, secure, or suitable for every purpose or device.
Educational questions are intended for wake-up engagement and general entertainment. They are not professional, medical, educational, safety, or emergency advice. Question content may contain mistakes or become outdated.
10. Limitation of liability
To the maximum extent permitted by law, TecDesigns LLC and its members, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits or data; missed alarms, appointments, travel, work, medication, caregiving duties, or obligations; device damage; or third-party service failures arising from or related to the Services.
Where liability cannot be excluded, our total liability for a claim related to the Services will not exceed the greater of the amount you paid for WakeMeUp-related purchases during the twelve months before the claim or ten U.S. dollars, except where applicable law requires a different remedy.
Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply to you.
11. Indemnification
To the extent permitted by law, you agree to indemnify and hold TecDesigns LLC harmless from third-party claims, damages, and reasonable costs arising from your unlawful use of the Services, violation of these Terms, misuse of purchased content, or infringement involving media or material you provide.
12. Changes and termination
We may update these Terms by posting a revised version and changing the "Last updated" date. Continued use after an update means you accept the revised Terms.
You may stop using the Services at any time. We may suspend server features or access where necessary for security, maintenance, legal compliance, store requirements, discontinuation, or violation of these Terms. Sections that by their nature should survive termination will remain in effect.
13. Governing law
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles, except where consumer-protection law in your jurisdiction requires otherwise. Courts located in Gwinnett County, Georgia, will have jurisdiction over disputes not subject to another mandatory venue.
14. General provisions
If any provision is found unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any applicable store terms, form the agreement between you and WakeMeUp concerning the Services.
